La rilevanza giuridica della gestione delle caselle PEC
Oggi giorno La gestione di caselle PEC ha semplificato i rapporti tra imprese, privati e pubbliche Amministrazione, innovando il sistema di comunicazione tra i diversi soggetti. La PEC è l’equivalente informatico della tradizionale raccomandata A/R, ovvero la raccomandata con ricevuta di ritorno.
L’obiettivo dell’impiego delle PEC è quello di dare ad un messaggio di posta lo stesso valore legale di una raccomandata classica con avviso di ricevimento, garantendo così la prova e l’invio della consegna.
Anche il Codice dell‘Amministrazione Digitale (d.lgs. n. 82/2005) fa esplicito riferimento alla gestione di caselle PEC agli artt. 6 e 48 con rinvio al D.P.R. 68/2005.
In particolare, l’obiettivo è quello di “Certificare” l’invio e la ricezione di messaggi PEC. Sono questi i due momenti fondamentali nella trasmissione dei documenti informatici al fine di fornire al mittente, dal proprio gestore di posta, una ricevuta che costituisce prova legale dell’avvenuta spedizione del messaggio e dell’eventuale allegata documentazione.
Allo stesso modo, quando il messaggio perviene al destinatario, il gestore invia al mittente la ricevuta di avvenuta (o mancata) consegna con precisa indicazione temporale.
Pertanto è possibile definire come garanti dell’avvenuta consegna dei messaggi inviati tramite caselle PEC, i gestori di posta che devono scriversi in un apposito elenco tenuto dall’AgID che svolge funzioni di vigilanza e controllo sul rispetto delle prescrizioni previste dal regolamento.
Obbligo di Pec, cosa rischia chi non si adegua?
Oggi la gestione di caselle PEC è uno strumento così importante che a conferma di questo suo valore, dal 1 ottobre 2020, la giurisprudenza ha previsto un regime sanzionatorio per imprese e professionisti che non hanno una casella PEC: Chi non è in regola rischia una sanzione da 206 a 2.064 euro (per le società) e da 30 a 1.548 euro (per le imprese individuali). Questo viene affermato dall’Art 37 DL 76/2020 ‘’Disposizioni per favorire l’utilizzo della posta elettronica certificata nei rapporti tra Amministrazione, imprese e professionisti‘’.
Non solo, la giurisprudenza, nella figura della Corte di Cassazione, Sezione Lavoro, n. 20072 del 7 ottobre 2015) dinanzi ad una notifica PEC effettuata in modalità difforme da quanto previsto dalla normativa (L. n. 53/94) ha reso nullo un procedimento notificatorio a causa della mancanza della ricevuta di avvenuta consegna.
Questo perché il procedimento non si esaurisce con l’invio telematico dell’atto, ma si perfeziona con la consegna del plico informatico nella casella PEC del destinatario, e la prova di tale consegna è costituita esclusivamente dalla ricevuta di avvenuta consegna.
La mancata produzione della ricevuta di avvenuta consegna della notifica a mezzo PEC ha reso nullo il ricorso per cassazione.
Ai fini della certificazione del messaggio PEC vengono quindi rilasciate diverse ricevute:
- Di accettazione: attesta l’invio della mail del gestore PEC del mittente;
- Di avvenuta consegna del messaggio: attesta che il destinatario ne ha piena disponibilità nella sua casella PEC. Le ricevute di consegna hanno piena validità legale anche se il messaggio non è stato effettivamente letto dal destinatario.
Un’ottimale gestione caselle pec diventa perciò un urgenza sempre più prioritaria soprattutto dal punto di vista legale.
