Lo scopo della conservazione delle PEC
Per la gestione PEC, il tema della conservazione a norma della PEC è sempre più d’attualità fra le organizzazioni. Già da tempo la PEC rappresenta l’innovazione nell’ambito della comunicazione tra persone, imprese, pubbliche amministrazioni e professionisti essendo un sistema di trasmissione sicuro e regolamentato dalla legge, al fine di inviare documenti e messaggi di posta elettronica con valore legale.
Questo valore legale non è dato dalla semplice stampa della PEC e delle ricevute di consegna e accettazione del messaggio in formato cartaceo oppure dal salvataggio in un archivio o nel proprio computer, bensì è necessario conservarla digitalmente in un sistema di conservazione a norma affinché possano essere garantite le caratteristiche di autenticità, di integrità, di affidabilità, di leggibilità e di immodificabilità.
Obbligo di conservazione pec, come adeguarsi?
La conservazione a norma dei messaggi PEC è un adempimento previsto dalla legge. In particolare, le pec devono essere conservate per 10 anni così come affermato dagli artt. 2214 e 2220 del C.C.
Lo strumento adatto a conservare copie non alterabili e sempre disponibili dei messaggi pec salvati è il servizio di conservazione sostitutiva che permette ad un documento informatico (sia esso un messaggio pec come anche qualsiasi altro documento informatico) di essere opponibile a terzi in sede di tribunale.
Oggi giorno, quasi tutte le organizzazioni, imprese, privati o pubbliche amministrazioni, possono affidare il servizio di conservazione a società specializzate con competenze legali e tecnologiche. Ad esempio, le imprese possono individuare società idonee ad offrire un servizio conforme alla normativa (Linee guida Agid, CAD, etc…), così come le pubbliche amministrazioni devono avvalersi dei servizi dei conservatori accreditati Agid e da questa controllati.
Archiviare e conservare PEC, sono la stessa cosa?
Molto spesso, le espressioni archiviare PEC e conservare PEC sono utilizzati in maniera impropria in quanto considerati sinonimi. Conoscere la distinzione di tali termini permette quindi di comprendere meglio, per ciascuno, il rispettivo campo di applicazione.
Definizioni
Nello specifico:
- Per archiviazione si intende un processo semplice tramite il quale un documento informativo viene collocato all’interno di uno spazio apposito o su un supporto digitale;
- Per conservazione si fa riferimento ad un processo più complesso rispetto al primo poiché permette di attribuire ai documenti informatici (ad. esempio un messaggio PEC) un valore giuridico dilatato nel tempo.
Differenze
- Il processo di archiviazione non è soggetto ad alcuna normativa di legge, ma allo stesso tempo, permette una più facile e veloce ricerca dei documenti salvati senza doverli necessariamente reperire in archivi cartacei;
- Tuttavia, per conservazione si vuole identificare una sorta di sostituzione dei documenti cartacei con quelli informatici assicurando che il documento non sia stato modificato e che sia rimasto integro e fedele al momento in cui è stato reso digitale.
