Obblighi e vantaggi della conservazione sostitutiva della PEC con Jamio
La conservazione sostitutiva della PEC per le organizzazioni è una prassi obbligatoria normata dal codice civile (articoli 2214 e 2220).
La legge in questione prevede la conservazione di PEC, documenti, lettere, telegrammi, fatture, (cartacei o digitali che siano).
Si dispone inoltre la conservazione a norma per almeno 10 anni di documenti legali o commerciali come:
- PEC
- Fatture.
- DDT.
- Ricevute fiscali e scontrini fiscali.
- Dichiarazioni fiscali.
- Bilanci d’esercizio.
- Pagamenti con i modelli F23 e F24)
- Registri Contabili.
- CUD.
Etc
La conservazione sostitutiva della PEC afferisce ad un ulteriore obbligo normativo in quanto la PEC è un documento di corrispondenza nativo digitale.
Non ha valore legale la conservazione di una PEC se stampata o salvata su proprio PC, in quanto processo di conservazione sostitutiva non normato dalla legge.
La conservazione a norma della PEC ha inoltre molteplici vantaggi tra cui il valore probatorio in merito alle comunicazioni effettuate o agli atti recapitati, tuttavia una mancata conservazione sostitutiva PEC, a differenza di altri documenti (quali le fatture elettroniche), non è sanzionata.
Per una conservazione della PEC a norma di legge vengono impiegati servizi di conservazione delle PEC esterni normati e accreditati, a cui inoltrare tutte le PEC per una ottimale conservazione sostitutiva della stessa.
Un sistema come Jamio fornisce, oltre a molteplici vantaggi di controllo e ottimizzazione della gestione delle PEC, un servizio inoltro delle PEC ai conservatori accreditati secondo le normative Agid, CAD, etc.

- Affidabilità e autenticità del processo di conservazione PEC e di documenti
- Sicurezza certificata nella trasmissione dei documenti e delle PEC da sottoporre a conservazione sostitutiva
- Certificazione comprovata del processo di conservazione sostitutiva PEC
- Definizione dei professionisti responsabili del processo di conservazione sostitutiva PEC
